A proper discharge of your duty requires that you should find the facts according to the weight of the evidence, and that you should accept from the Court the law which defines the rights of the parties. The Schuylkill River is one of the navigable rivers of the State of Pennsylvania. Above the lower falls it was originally navigable only by boats of very light draft. For the purpose of improving the navigation and increasing its capacity the Legislature, by an Act approved March 8, 1815, incorporated the company known as The President, Managers and Company of the Schuylkill Navigation Company.
