Book excerpt: Excerpt from Reports of Cases Decided in the Eastern District Court of the Colony of the Cape of Good Hope, Vol. 10 AS regards their claim B there was no dispute, defendants making a tender which was accepted; but as to A defen dants tendered the amount, except 75, rent at 73. 6d. An acre, for the year 1894 for four allotments of 50 acres each, which four allotments plaintiffs had agreed in 1893 to take back, but by mistake defendants had ploughed with the rest of the farm. Claim C was for 5000 damages for breach of contract and for neglect by defendants of their duty, in that they had hired the lands from February 1894 upon the same terms and conditions upon which the immi grants had occupied, and were occupying, the same, and so were bound to keep the houses, gates, and fences in repair, to keep the main water furrow clean, and to keep the arable lands free from noxious weeds, and to plough in the stubble on the said lands immediately after the crops were reaped. With regard to this last claim defendants pleaded that they had agreed to hire the said land as mere lessees, without reference to the Special conditions binding on the settlers, and without any contract or undertaking in regard to such conditions, and tendered 100 in full settlement.
