Book excerpt: Excerpt from The Indiana Magazine of History, Vol. 6: March, 1910 The theory, heretofore not much more than a theory, which legislators and courts are now making more a matter of practice, is that there are three parties to every divorce suit, the plaintiff, the defendant and the State. It is in following out this theory that the State has provided that the prosecuting attorney shall ap pear in person, or by deputy, in every case Where the defendant Is not otherwise represented.
